Nesse sentido, podemos citar o <\/span><a href=\"https:\/\/mrcla.com.br\/en\/servicos\/marco-legal\/\"><span style=\"font-weight: 400;\">Novo Marco Legal<\/span><\/a><span style=\"font-weight: 400;\">, uma mudan\u00e7a significativa para incentivar o desenvolvimento das vias.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Atualmente, a <\/span><span style=\"font-weight: 400;\">Ag\u00eancia Nacional de Transporte Terrestres<\/span><span style=\"font-weight: 400;\"> (<a href=\"https:\/\/portal.antt.gov.br\/ferrovias\" target=\"_blank\" rel=\"noopener\">ANTT<\/a>), fundada em 2001, \u00e9 respons\u00e1vel por <\/span><b>monitorar, gerenciar e fiscalizar<\/b><span style=\"font-weight: 400;\"> a malha ferrovi\u00e1ria.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Neste artigo, abordaremos a estrutura da regulamenta\u00e7\u00e3o dos servi\u00e7os de transporte ferrovi\u00e1rio, as concess\u00f5es e novidades da legisla\u00e7\u00e3o. Aproveite a leitura!<\/span><\/p>\n<h2><b>Quem regula a atividade ferrovi\u00e1ria brasileira?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">As atividades de transporte na modalidade ferrovi\u00e1ria brasileira sofreu influ\u00eancias do setor privado a partir dos anos 1990, culminando com a privatiza\u00e7\u00e3o da Rede Ferrovi\u00e1ria Federal S.A. (RFFSA) e a entrada de operadores da iniciativa privada.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Apesar disso, o governo ainda det\u00e9m responsabilidades sobre a <\/span><b>fiscaliza\u00e7\u00e3o das ferrovias <\/b><span style=\"font-weight: 400;\">e conta com a ANTT para isso.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Conforme o primeiro artigo da <\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/leis_2001\/l10233.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Lei 10.233<\/span><\/a><span style=\"font-weight: 400;\">, a ag\u00eancia deve cumprir os seguintes objetivos em suas respectivas esferas e atribui\u00e7\u00f5es:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">controlar a competi\u00e7\u00e3o mercadol\u00f3gica e evitar as infra\u00e7\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">assegurar que a movimenta\u00e7\u00e3o de bens e pessoas seja feita com regularidade e seguran\u00e7a;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">supervisionar a presta\u00e7\u00e3o de servi\u00e7os e explora\u00e7\u00e3o da infraestrutura de transportes, exercidas por terceiros;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">implementar as pol\u00edticas formuladas pelo <\/span><a href=\"https:\/\/www.gov.br\/infraestrutura\/pt-br\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Minist\u00e9rio dos Transportes<\/span><\/a><span style=\"font-weight: 400;\"> e <\/span><span style=\"font-weight: 400;\">Conselho Nacional de Integra\u00e7\u00e3o de Pol\u00edticas de Transporte<\/span><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/www.gov.br\/infraestrutura\/pt-br\/assuntos\/conteudo\/conit\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">CONIT<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Al\u00e9m disso, a ANTT tem obriga\u00e7\u00e3o de:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">publicar editais;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">julgar licita\u00e7\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">preservar o patrim\u00f4nio hist\u00f3rico;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">gerenciar contratos de concess\u00f5es;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">regular, fiscalizar e condenar os atos dos concession\u00e1rios, entre outras a\u00e7\u00f5es.<\/span><\/li>\n<\/ul>\n<h2><b>Qual \u00e9 o papel da legisla\u00e7\u00e3o?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira tem o papel de regulamentar os transportes na malha ferrovi\u00e1ria. Assim, determina a maioria das regras referentes aos<\/span><b> espa\u00e7os, processos e setores de atua\u00e7\u00e3o<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Essa regulamenta\u00e7\u00e3o ajuda a estabelecer o relacionamento entre as operadoras das concess\u00f5es e o governo. N\u00e3o h\u00e1 d\u00favidas que com ferrovias mais seguras, os acidentes e riscos diminuem.<\/span><\/p>\n<h2><b>Como foi a evolu\u00e7\u00e3o da legisla\u00e7\u00e3o desde sua promulga\u00e7\u00e3o?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira para esse modelo com ag\u00eancia reguladora foi <\/span><a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/decreto\/1996\/d1832.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">criada em 1996<\/span><\/a><span style=\"font-weight: 400;\"> e sua evolu\u00e7\u00e3o resultou na institui\u00e7\u00e3o da ANTT.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ao longo da trajet\u00f3ria da ANTT, foram editados diversos normativos que abordam a opera\u00e7\u00e3o ferrovi\u00e1ria, sobre as tarifas cobradas no transporte ferrovi\u00e1rio e determina\u00e7\u00f5es referentes a acidentes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Da mesma forma, a legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira passou a <\/span><b>controlar a explora\u00e7\u00e3o da infraestrutura de transportes<\/b><span style=\"font-weight: 400;\"> e assegurar a movimenta\u00e7\u00e3o das pessoas e dos bens, entre outros assuntos relevantes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As resolu\u00e7\u00f5es atuais, como a <\/span><a href=\"https:\/\/anttlegis.antt.gov.br\/action\/ActionDatalegis.php?cod_menu=7764&amp;cod_modulo=423&amp;acao=recuperarTematicasCollapse\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">n.\u00ba 4.624 de mar\u00e7o de 2015<\/span><\/a><span style=\"font-weight: 400;\">, estabelecem a contrata\u00e7\u00e3o e manuten\u00e7\u00e3o de seguros no \u00e2mbito das concess\u00f5es ferrovi\u00e1rias.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Um passo significativo nessa evolu\u00e7\u00e3o foi a edi\u00e7\u00e3o do<\/span><span style=\"font-weight: 400;\"> Marco <\/span><span style=\"font-weight: 400;\">Legal das Ferrovias, cujo prop\u00f3sito \u00e9 permitir a constru\u00e7\u00e3o de ferrovias pela iniciativa privada por meio de autoriza\u00e7\u00e3o, al\u00e9m de fomentar a explora\u00e7\u00e3o de trechos em processo de devolu\u00e7\u00e3o ou desativa\u00e7\u00e3o, linhas ociosas e n\u00e3o implantadas.<\/span><\/p>\n<h2><b>Quais s\u00e3o as principais caracter\u00edsticas dessa legisla\u00e7\u00e3o para as concession\u00e1rias?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">As concession\u00e1rias contar\u00e3o com o Novo Marco Legal para desenvolver determinados trechos, realizando investimentos de modo a impulsionar seus neg\u00f3cios.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Asim, o Novo Marco Legal permite que empresas possam solicitar autoriza\u00e7\u00e3o para implantar uma ferrovia com carga burocr\u00e1tica menor.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">O Novo Marco Legal estabeleceu a possibilidade dos <\/span><i><span style=\"font-weight: 400;\">players <\/span><\/i><span style=\"font-weight: 400;\">do setor se associar para formar uma <\/span><b>entidade autorreguladora <\/b><span style=\"font-weight: 400;\">e, consequentemente, padr\u00f5es t\u00e9cnico-operacionais podem ser definidos sem depender do Estado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Al\u00e9m disso, a desburocratiza\u00e7\u00e3o facilita a entrada de novas concession\u00e1rias para investir na malha ferrovi\u00e1ria e <\/span><b>aumentar a concorr\u00eancia<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ainda assim, vale ressaltar que o Governo ainda conta com o dever de regular as situa\u00e7\u00f5es pontuais e quest\u00f5es de seguran\u00e7a.<\/span><\/p>\n<h2><b>Qual \u00e9 o impacto do Marco Legal das Ferrovias?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A legisla\u00e7\u00e3o ferrovi\u00e1ria brasileira teve v\u00e1rias mudan\u00e7as, com o intuito de atualizar a infraestrutura da malha ferrovi\u00e1ria.
