Sua principal inova\u00e7\u00e3o \u00e9 instituir a autoriza\u00e7\u00e3o ferrovi\u00e1ria, modalidade de concess\u00e3o em regime privado.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A mudan\u00e7a trar\u00e1 processos mais simplificados para investidores interessados em participar dos projetos de <\/span><b>amplia\u00e7\u00e3o e moderniza\u00e7\u00e3o da malha ferrovi\u00e1ria<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Outro importante instrumento contemplado no Marco Legal diz respeito ao acesso de terceiros \u00e0 malha ferrovi\u00e1ria, conhecido como Direito de Passagem.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Com esse modelo, as operadoras log\u00edsticas podem assumir a <\/span><b>constru\u00e7\u00e3o e opera\u00e7\u00e3o <\/b><span style=\"font-weight: 400;\">de trechos ferrovi\u00e1rios, enquanto o Governo se concentra em projetos mais complexos, principalmente aqueles que atravessam v\u00e1rios estados.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Al\u00e9m disso, o Governo pode lan\u00e7ar chamadas p\u00fablicas para avaliar o interesse dos investidores em reviver trechos ferrovi\u00e1rios que est\u00e3o ociosos h\u00e1 anos.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Outra novidade interessante \u00e9 <\/span><b>autorregula\u00e7\u00e3o ferrovi\u00e1ria<\/b><span style=\"font-weight: 400;\">, que possibilita que as operadoras ferrovi\u00e1rias:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">conciliem conflitos;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">instituam normas t\u00e9cnicas volunt\u00e1rias;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">planejem e administrem em coopera\u00e7\u00e3o sobre a opera\u00e7\u00e3o;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">criem programas de gest\u00e3o de manuten\u00e7\u00e3o, riscos e garantias das opera\u00e7\u00f5es de transportes.<\/span><\/li>\n<\/ul>\n<h2><b>O que ser\u00e1 mantido<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Apesar do Marco Legal, ainda caber\u00e1 ao governo determinar as introdu\u00e7\u00f5es com objetivo de <\/span><b>assegurar a compet\u00eancia do sistema.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Os modelos de concess\u00e3o ferrovi\u00e1ria continuam a existir, em casos de grandes projetos envolvendo:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">v\u00e1rios estados;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">cargas m\u00faltiplas;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">interesses comuns.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Nesses casos, h\u00e1 vantagem na pol\u00edtica ferrovi\u00e1ria por parte do Estado brasileiro, tornando mais interessante o regime de concess\u00e3o.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As regras do Marco Legal das Ferrovias buscam dar maior clareza \u00e0s responsabilidades de cada uma das partes envolvidas, incluindo a <\/span><b>partilha de riscos com o governo<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Vale ressaltar que devem ser feitos ajustes de modo a <\/span><b>corrigir quest\u00f5es de governan\u00e7a, processuais e transpar\u00eancia<\/b><span style=\"font-weight: 400;\">. Assim, a empresa aumentar\u00e1 a rede gerenciada e pode come\u00e7ar a trabalhar em mais trechos sob o novo modelo.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Al\u00e9m disso, o Marco Legal facilita a cria\u00e7\u00e3o de chamadas p\u00fablicas para convidar investidores interessados em explorar as vias f\u00e9rreas ociosas ou em processo de desativa\u00e7\u00e3o.<\/span><\/p>\n<h2><b>Investimentos fortalecidos<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">O Marco Legal das Ferrovias pode fortalecer os investimentos no transporte ferrovi\u00e1rio e contribuir com o desenvolvimento ferrovi\u00e1rio do pa\u00eds, permitindo <\/span><b>agilidade na log\u00edstica das grandes empresas que fazem uso intensivo de transporte de cargas<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Al\u00e9m de reduzir a burocracia, a medida viabiliza novos projetos de ferrovias para <\/span><b>ampliar e desenvolver a malha atual<\/b><span style=\"font-weight: 400;\">. Como j\u00e1 mencionado, a nova regulamenta\u00e7\u00e3o pode dar nova chance para opera\u00e7\u00e3o dos trechos que est\u00e3o atualmente ociosos.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Investidores e, em especial, empresas fabricantes de produtos que dependem de transporte de grande tonelagem j\u00e1 demonstraram enorme interesse na outorga de autoriza\u00e7\u00e3o para constru\u00e7\u00e3o de novos trechos. At\u00e9 o dia 18 de janeiro de 2022, j\u00e1 foram apresentadas 64 solicita\u00e7\u00f5es, o que implicar\u00e1 no <\/span><b>investimento de R$ 180 bilh\u00f5es e 15 mil quil\u00f4metros<\/b><span style=\"font-weight: 400;\">.
